Terms of service.
The rules that apply when you book a shoot with Rise Imagery, use the client portal, or buy a fine-art print. Plain English, but they’re a contract.

1. Who these terms are with
The studio (“Rise Imagery”, “we”, “us”) is Tom Tegel trading as Rise Imagery (ABN 57 641 189 784), based in Batemans Bay, NSW. You (“the client”, “you”) are the person or business who commissions a shoot, signs into the portal, or purchases a print. By engaging us, signing a quote, or placing an order you accept these terms.
2. Commissioned shoots
2.1 How a booking is formed
A booking is confirmed when you accept a quote in writing (email, portal, or signed document) and we acknowledge the confirmation. Dates are only held once a deposit is paid.
2.2 Deposits
Unless agreed otherwise in writing, a 25% deposit is payable at booking and is non-refundable once we have committed to the date and any necessary travel. The balance is payable on delivery or as set out on the invoice. Larger bookings may require a staged payment schedule.
2.3 Cancellations and rescheduling
- More than 7 days out: rescheduling is free; a cancellation forfeits the deposit only.
- 3–7 days out: 50% of the quoted fee is payable.
- Under 72 hours:100% of the quoted fee is payable (the date can’t be resold at that notice).
- Weather postponements at our discretion or yours for outdoor and aerial work do not attract a fee, but travel costs already incurred are payable.
- Rescheduled dates are subject to our availability and remain bound by these cancellation terms against the new date.
2.4 Weather, safety, and CASA rules
Aerial work is weather- and airspace-dependent. We reserve the right to ground the drone or move the shoot window if conditions or Civil Aviation Safety Authority (CASA) rules require it. Safety decisions rest with the pilot in command. We do not undertake commercial aerial work unless we hold a current Remote Pilot Licence (RePL) and, where required, an Operator’s Certificate (ReOC) or appropriate sub-2kg notification.
2.5 Access and permissions
You confirm that you have the right to allow us onto the property being photographed, to instruct us to photograph or film it, and that any required landlord, strata, or airspace permissions are in place. If access is blocked on the day and we cannot shoot, the call-out fee and travel are payable.
2.6 Travel
Shoots within Eurobodalla Shire include travel unless the quote says otherwise. Work outside the shire attracts a travel fee agreed in the quote.
3. Copyright, licensing, and use
3.1 Ownership
Under the Copyright Act 1968 (Cth), copyright in the photographs and video we produce is owned by Rise Imagery unless we sign a separate assignment in writing. You are granted a licence to use the delivered images under the terms below.
3.2 Standard commercial licence
Unless your quote states otherwise, the licence granted on payment in full is:
- Non-exclusive, worldwide, and royalty-free, in perpetuity.
- Limited to the client named on the invoice and, where reasonable, its agents (e.g. a real estate agency marketing the listed property).
- For the commercial purpose for which the shoot was commissioned — listing, marketing, and brand use on websites, social media, print collateral, and advertising.
- Not sub-licensable to third parties for separate commercial gain (e.g. stock libraries, resale to other agencies).
3.3 Real estate note
Real estate images are licensed to the listing agency for marketing of the listed property and end when the property is sold or withdrawn. The property owner may be granted a personal-use licence on request. Use by an incoming or competing agency requires a new licence.
3.4 Portfolio and marketing use by Rise Imagery
We retain the right to use the delivered images to promote the studio — our portfolio, website, social media, journal, and print submissions. If your shoot is commercially sensitive and you need a portfolio embargo, tell us in writing before the shoot and we will agree a period.
3.5 Attribution
Attribution (“Photo by Rise Imagery”) is appreciated but not required on commercial uses. It is required on editorial and journalistic reuse where the law recognises a moral right of attribution.
3.6 No payment, no licence
No licence to use the images exists until the invoice is paid in full. Using unpaid images is copyright infringement.
4. Delivery
Edited files are delivered through the Rise Imagery client portal unless another method is agreed. Delivery timelines are set out in the quote — typical real-estate turnaround is 24–48 hours; brand and editorial work is 7–14 days. Raw files are not delivered unless separately agreed and quoted.
Galleries are kept on the portal for at least twelve months. Longer-term archival is available on request; otherwise you are responsible for backing up your copy.
5. Client portal
Access to the portal requires a one-time email code. You are responsible for keeping your email account secure and for the actions of anyone you invite into your organisation. Share links can be revoked at any time; we will revoke a link on request from the owning client.
You may not attempt to access other clients’ data, probe the system for weaknesses without our written permission, or upload malicious content. We may suspend or terminate accounts that breach these rules.
6. Fine-art print shop
Prints are produced to order. Typical production and shipping is 10–14 business days within Australia. Once produced, prints are final sale unless they arrive damaged or differ materially from what was ordered, in which case we will replace them at our cost.
Nothing in these terms excludes your rights under the Australian Consumer Law — in particular, your right to a refund, replacement, or repair for goods that are not of acceptable quality.
7. Invoices and late payment
Invoices are issued via Stripe and are payable within the period shown on the invoice (typically 7 or 14 days from issue). We reserve the right to charge interest at the RBA cash rate plus 2% on amounts unpaid 14 days past the due date, and to recover reasonable collection costs. Delivered images may be withdrawn from use until the invoice is paid in full.
8. Liability
To the maximum extent permitted by law, our total liability to you arising out of or in connection with a shoot or a print order is limited to the fees you have paid for that engagement. We are not liable for consequential loss, loss of profit, or loss of business opportunity. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded, including under the Australian Consumer Law.
We hold public liability insurance and, for commercial aerial work, drone-specific insurance to the minimum levels required by our insurer and by CASA where applicable.
9. Privacy
Personal information collected in connection with a booking, the portal, or the shop is handled in line with our privacy policy.
10. Governing law
These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of NSW and, where relevant, the federal courts of Australia.
11. Changes
We may update these terms from time to time. The version published on the site at the time of your booking or order is the version that applies to that engagement.
